Any order registered is considered firm and irrevocable. It also implies acceptance of the following Terms & Conditions. These Terms & Conditions apply to and are deemed incorporated in all contracts for the sale of the Company’s goods and services, unless the contrary is expressly and specifically agreed in writing by the Company. They exclude any terms and conditions proffered by the Customer. The Company may cancel this contract forthwith if the Customer becomes bankrupt or makes any composition for the benefit of creditors or being a Company goes into liquidation either voluntarily or compulsorily.

These conditions shall be construed in accordance with the laws of England.


  1. Terms are strictly as stated on invoice.
  2. Any account past its due date will be placed on stop, until that account is settled in full.
  3. Should payment remain outstanding, FATHOM Outdoors Ltd reserve the right to place any account on a Pro-Forma basis. 
  4. Pro-Forma invoices will be held for 30 days from the date of invoice. Goods can only be reserved for 7 days.
  5. Payment must be made for the oldest invoice first.
  6. Remittance advice indicating invoices being paid must be included with payment.
  7. Overdue invoices will be subject to a periodic interest charge in line with our statutory right to claim interest on late payment. This entitles us to charge 8%, plus the current reference rate. The Bank of England base rate as at 31st December is used as the reference rate for debts becoming overdue between January 1st and June 30th. The rate in force on June 30th is used between July 1st and December 31st.
  8. FATHOM Outdoors Ltd reserves the right to invoice any deducted discount if the account becomes delinquent. 
  9. Errors in accounts must be notified to FATHOM Outdoors Ltd within 3 working days of invoice receipt.
  10. Any payment made by credit card may incur a 4% + VAT charge on the total invoice value.
  11. Cheques that are not honoured for payment will be subjected to an administration charge of £25.00 for each representation.

  2. Minimum order value of £20.00 total. Any order of less value will carry a handling charge of £5.00.
  3. Back orders will stand until stock is available. Cancellation of back orders remains the responsibility of the Dealer and should be notified to FATHOM Outdoors Ltd in writing.
  4. Any shortage of delivery or incorrect delivery should be notified to FATHOM Outdoors Ltd in writing within 3 working days of delivery.
  5. Whilst every effort is made to deliver goods on time, we cannot be held responsible for any delays in despatch where supply or production of goods is out of our control. In the absence of explicit agreement to the contrary, a delay in delivery times does not give rise to any indemnity or order cancellation.


  1. All returns for credit must have prior authorisation from FATHOM Outdoors Ltd before being sent back. 
  2. Should we choose to accept a product for return, serviceable returns will be subject to a 20% re-stocking charge.
  3. Non-serviceable returns and, or product no longer current, will not be accepted for credit or exchange.
  4. Carriage for returns for credit or warranty will be the responsibility of the Dealer.
  5. All returns must be accompanied by an explanation of the reason for return on company stationery or returns document.

Retention of Title

All goods supplied by FATHOM Outdoors Ltd remain our property until paid for in full. Claims for shortages, sent in error or faulty product must be made in writing within three days of receipt of goods. The risk in the goods shall pass from the seller to the buyer upon delivery of such goods to the buyer. However, notwithstanding delivery and the passing of risk in the goods, title and property in the goods, including full legal and beneficial ownership, shall not pass to the buyer until the seller has received in cash or cleared funds payment in full for all goods delivered to the buyer under this and all other contracts between the seller and the buyer for which payment of the full price of the goods there under has been paid. Payment of the full price of the goods shall include the amount of any interest or other sum payable under the terms of this and all other contracts between the seller and the buyer under which the goods were delivered.


  1. FATHOM Outdoors Ltd reserves the right to withdraw goods and services from any Dealer in breach of these conditions. 
  2. Warranty returns are subject to the conditions as stated in FATHOM Outdoors Ltd’s warranty programme.
  3. All pricing is subject to change without notice. Whilst every effort is made to verify the accuracy of this price list, FATHOM Outdoors Ltd does not accept responsibility for any inaccuracies. Orders are therefore accepted subject to prices prevailing at the time of despatch.
  4. Possession of a price list does not constitute an offer to sell.
FATHOM Outdoors Ltd distributes products and respective registered trademarks. Unauthorised use of these trademarks is not allowed. For the purpose of brevity, the word Oceanic used in this document will include all products sold and distributed by FATHOM Outdoors Ltd

FATHOM Outdoors Ltd have added these terms and conditions to those already contained in the FATHOM Authorised Trade Price List. The purpose of these additions is to ensure that our products are treated fairly and equally alongside other manufacturers ranges. The detail of the agreement is as follows;

  1. For the safety of the consumer, you should only sell new and unused products in their original packaging and with the relevant user manual included.
  2. In order to avoid any risks of misleading the consumer with regard to the availability of products and to be able to take account shortfalls in production, as well as for confidentiality reasons with regard to the launch of new products, the dealer shall not announce, present or promote Oceanic products until prior confirmation by FATHOM Outdoors Ltd that these products have been actually produced, are available and can be supplied.
  3. Products purchased by an Authorised Dealer and then resold to an unauthorised reseller are considered "third party sales" and are not allowed. This not only applies to products contained in the FATHOM Trade Price List, but also to Spares & Service Parts as supplied by FATHOM Outdoors Ltd. 
  4. Products sold to end-users by an unauthorised reseller may forfeit the end user certain rights and warranties to the products as allowed by law.
  5. The Authorised Dealer does not have the authority to offer warranty terms or conditions other than that which is offered and approved by FATHOM.
  6. FATHOM Outdoors Ltd tracks certain products by serial number from source to dealer for safety and distribution purposes. The Authorised Dealer is expected to assist FATHOM Outdoors Ltd should tracking of a product to the end user via the serial number become necessary.
  7. FATHOM Outdoors Ltd requires the Dealer to operate their account within the agreed payment terms as staled on the invoices for goods.
  8. Minimum Annual Turnover required to maintain Authorised Dealer status is £5000. Authorised FATHOM Dealers may apply to become an Authorised Service Centre and would be expected to stock a full range of the brands Regulators.


  1. All brands we represent have invested heavily in creating a brand synonymous with quality, innovation and cutting-edge technology. Our business model calls for all of our represented product lines to be positioned as a premier line of equipment available only through full-service, professional Dealers. FATHOM Outdoors Ltd has determined the best way to assure the success of the brand against its competitors is to sell only to those Dealers that provide superior service, position our brands products as premium quality products, and aggressively promote all brands. Dealers that do not meet these criteria and take advantage of the efforts and investment of FATHOM Outdoors Ltd and its authorised Dealers may, in FATHOM Outdoors Ltd’s judgment, damage the brands positioning in the marketplace and its ability to compete in the most effective manner.
  2. The Authorised Dealer will refrain from activities and practices that could negatively affect the brand image and good standing that FATHOM Outdoors Ltd desires to have. These include discriminating acts where product is treated differently from other product lines the Authorised Dealer represents.
  3. All of our products branding on a dealer 's internet site must have at least equal prominence to any other manufacturers I distributors branding on that site.

Internet Sales


  1. If the Authorised Dealer offers Oceanic products for sale on the Internet, the Internet site must be clearly identified as belonging to and associated with the Authorised Retailer.
  2. The dealer should have in stock a high proportion of the each branded products that are offered for sale on the dealer’s website.
  3. In the interest of clarity, we request that the price of all products offered for sale will show all local taxes. This should be shown on the main product page rather than the checkout page.

Territorial Limits

  1. Products sold via the internet site must not be shipped or delivered outside of your authorised region, which is Europe. The Authorised Dealer is required to state its shipping policy, including the area served for the shipment and delivery of all products, directly on their website in a manner obvious and clear to the internet site visitor. However, at this time FATHOM Outdoors Ltd will allow sales outside Europe. On receiving notification that FATHOM Outdoors Ltd require the implementation of this clause, the store will cease all sales outside Europe and update their website with the required information within 2 days of receiving that notice.

Internet Marketplaces

  1. A dealer may sell our products via the internet only through websites owned or controlled by the dealer that are maintained in accordance with the policies in this document.
  2. The distribution of our products via so called " internet marketplaces " and via other Internet distribution platforms owned or controlled by third parties is prohibited. However, at this time, FATHOM Outdoors Ltd will permit the sales on these sites subject to the following;
  3. That the trading name on these sites is the same as the name of the Dive Store concerned. This must readily identify the dealer who is offering the product as the dealer to whom we are supplying the product.
  4. No new, current products are to be sold via 'auctions '. They may only be sold at a 'buy it now' price. Any second hand product or closeout product offered must be clearly marked in the description as such.
  5. On receiving notification that FATHOM Outdoors Ltd requires that the sales on these sites cease, the store will remove all listings of such products within 2 days of receiving that notice.

Used Product

  1. Used product may be offered for sale on line only in a section of your website clearly noted used product. A Dealer is not permitted to offer used gear in any section of their website that offers new product.
  2. If you are going to offer used product in your used product section, you must show the actual photo of that particular product. If you have more than one of any particular item each product must be individually photographed.
  3. Under no circumstance are you allowed to substitute new gear in place of used gear being offered.
  4. You must offer all of the requisite manuals I documentation with any 2nd hand I used product.


  1. FATHOM Outdoors Ltd sell product only within their licensed territory. This territory consists of England, Scotland, Wales, Northern Ireland, Republic of Ireland, Isle of Man and the Channel Islands. As such we are only obligated to supply Instruction Manuals and Warranty documentation in UK English. However, the dealer should note that they have a responsibility to supply the required documentation in the local language of the country w here they may send product. It may be possible for FATHOM Outdoors Ltd to supply some of this documentation, but there will be an additional charge
  2. The dealer also has a responsibility to have available in their organisation, a member of staff who is able to converse with their customer in the local language of the country where they may send product. This is to ensure that the customer may be fully conversant with all aspects of our products that they wish to, or have purchased.
  3. The Authorised Dealer will provide warranty and non-warranty service for all products purchased by an end user who have legitimate proof of purchase from an Authorised Dealer located any w here in the world.
  4. The Authorised Dealer who intends to offer servicing and repair of our product will need to attend training classes related to the use and maintenance of such products. An adequate stock of spare parts necessary to perform repair and maintenance will be on hand at all times. 

Use of third party (non-branded) parts is not allow ed. The Technician (s) must attend any updates as and when required by FATHOM Outdoors Ltd.


  1. FATHOM Outdoors Ltd acknowledges that dealers may choose to sell our products at any price and in any lawful manner they choose. Subsequently, FATHOM Outdoors Ltd may choose to sell its products exclusively to professional retailers that meet all of the above criteria.


  1. It is important to understand that FATHOM Outdoors Ltd is not seeking your agreement with our terms and condition s and will not accept any offers of such agreement. This Policy is a unilateral statement by FATHOM Outdoors Ltd. Neither employees nor FATHOM representatives are authorised to consider or reach any agreement with any Dealer about our terms and conditions. All questions regarding these terms and conditions should be directed, in writing, to Kelvin Richards, Managing Director.


  1. For any items that are out of stock, back orders are dispatched carriage free.
  2. All orders despatched with a total invoice value (excluding VAT and carriage) of £1000 or more will be sent carriage free. This only includes orders sent to an address in England, Wales and the low lands of Scotland. Other areas of the UK will be charged as set out below. The order must be sent to a single address.
  3. Sofnolime and Cylinders are not included in the carriage free or free shipping back order offer.
